INFORMATION CONCERNING THE PROCESSING OF PERSONAL DATA – CONTRACTORS

Due to entry into force of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (hereinafter referred to as GDPR) on 25 May 2018, we would like to inform you about the processing of personal data obtained by BTV sp. z o.o.. The information presented below indicates the most important issues related to the processing of personal data and the rights of natural persons with regard to the processing of their personal data.

1. THE CONTROLLER

The controller of personal data is BTV Spółka z ograniczoną odpowiedzialnością with its registered office at ulica Majdańska 24/3, 04-110 Warsaw, company registered in District Court for the capital city of Warsaw, XIII Economic Division of the National Court Register

2. SCOPE OF PERSONAL DATA PROCESSED

The Controller processes personal data of its contractors. Processed data may include, in particular: name and surname, contact data (address, e- mail address, telephone number), information from ID Card, NIP, PESEL. The scope of processed data may vary depending
on the scope of personal data which was provided to us by you in connection with the conclusion of contracts or their execution.

3. THE PURPOSE AND DURATION OF THE PROCESSING OF PERSONAL DATA

The data may be processed for:

  • a) the performance of a contract to which the data subject is party or in order to take steps at the request of the data subject prior
    to entering into a contract (Article 6 section 1 point (b) of GDPR),
  • b) compliance with a legal obligation to which the Controller is subject in connection with taxation and documentation of transactions (Article 6 section 1 point (c) of GDPR); and in this respect the data will be processed for the period resulting from tax legislation,
  • c) the purposes of the legitimate interests pursued by the Controller or by a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require protection of personal data, in particular where the data subject is a child,
  • d) establishing, exercising or defending legal claims – until the claims become prescribed,
  • e) carrying out direct marketing activities – until the end of validity of individual contracts referred to in point (a) above.

4. VOLUNTARY PROVISION OF PERSONAL DATA

We would like to point out that, as a rule, there is no obligation to provide personal data. However, failure to provide such information will prevent the conclusion of an agreement and the start or continuation of cooperation with the Controller.

5. RECIPIENTS OF PERSONAL DATA PROCESSED

The Controller – just like many other entrepreneurs – uses the services provided by third parties and if it is required by the proper performance of the Controller’s services or tasks – transfers personal data of natural persons to the necessary extent. This is particularly the case with respect to:

  • a) IT services and solutions providers (e.g. fault report management system),
  • b) entities acting as intermediaries in the performance of contracts (subcontractors, entities providing postal and courier services),
  • c) entities providing clearing, payment and collection services (e.g. a system for invoicing or recording the circulation of documents),
  • d) entities providing advisory services (e.g. legal and financial law firms),
  • e) entities acting as intermediaries in conducting marketing actions,
  • f) entities entitled to obtain data on the basis of provisions of law, including law enforcement agencies, tax authorities or other
    public bodies and institutions.

In the case of transfer of personal data, we take care to ensure that the entities to which the data are entrusted are reliable and guarantee a high standard of not only the services provided, but also the protection of personal data and keeping them confidential. To this end, we conclude appropriate agreements regulating the security of the entrusted data. If we transfer data to entities established in third countries (i.e. outside the European Economic Area), we will require these entities to guarantee a high level of protection of personal data, comply with European data protection standards and conclude appropriate agreements based on the model contractual clauses on data protection adopted by the European Commission. The data will not be used for automated decision-making, including profiling.

6. THE RIGHTS OF NATURAL PERSONS WITH REGARD TO PROCESSING OF PERSONAL DATA

Every data subject has the right to:

  • a) access the data within the scope defined by the provisions of GDPR (Article 15 of GDPR),
  • b) rectification of data (Article 16 of GDPR),
  • c) request the deletion of data if one of the conditions indicated by the provisions of GDPR if fulfilled (Article 17 of GDPR),
  • d) demand limitation of data processing in cases specified by the provisions of the GDPR (Article 18 of GDPR),
  • e) request the transfer of data in cases specified by GDPR (Article 20 of GDPR),
  • f) lodging a complaint to the supervisory authority, which is the Prezes Urzędu Ochrony Danych Osobowych (Article 77 of GDPR).

Any person whose data are processed for purposes resulting from legitimate interests pursued by the Controller has the right to object to the processing of data for reasons related to his or her particular situation. In the case of processing of data for the purposes of direct marketing, an objection may be raised at any time and for any reason against the processing of data in connection with such direct marketing (Article 21 of GDPR). In this respect, the data shall be processed throughout the entire period of performance of individual agreements or, in the absence of an agreement, until the end of negotiations or until the end of acting as a contact person, representative or proxy under an agreement,
  • b) establishing, exercising or defending legal claims – until the claims become prescribed.

4. VOLUNTARY PROVISION OF PERSONAL DATA

We have obtained your personal data from your employer or principal, who indicated it as the data of a representative, proxy or a contact person in connection with concluding a contract or conducting negotiations in order to conclude a contract. However, in some cases, such a need results from the Controller’s legitimate interest in the form of the necessity of processing such data in order to conduct normal business activity, such as maintaining contact with contractors and potential customers or business partners.
